DANA Foundations
Website Terms of Use
These Website Terms of Use (“Terms”) govern access to and use of danafoundations.org (the “Website”), operated by Diversity Activities National Association (“DANA,” “DANA Foundations,” “we,” “us,” or “our”). DANA is a nonprofit organization described as a 501(c)(3) organization.
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
1. Eligibility and use by minors
You must be legally able to agree to these Terms to use the Website. If you are under the age of majority where you live, you may use the Website only with the involvement, consent, and supervision of a parent or legal guardian. Parents and guardians are responsible for minors’ use of the Website.
The Website is not intended to collect sensitive personal information from children. Do not submit personal, medical, mental-health, foster-care, or other sensitive information about a child through the Website unless specifically requested through an appropriate, secure process.
2. Website information and services
The Website provides information about DANA’s mission and activities, including family and youth training, mental health and trauma support, foster care transition services, community and educational activities, and related resources. It may also provide access to an online shop, donation services, and links to third-party websites and services.
Website content is provided for general informational purposes only. It may be incomplete, may not reflect the most current information, and is not a promise that a particular program, service, event, product, or resource will be available or suitable for you. Contact DANA directly to confirm current offerings and eligibility.
3. No professional advice; no emergency use
Information on the Website is not medical, mental-health, psychiatric, therapeutic, legal, or other professional advice. It does not create a provider-client, therapist-client, attorney-client, or other professional relationship with DANA. Do not rely on Website content as a substitute for advice or care from a qualified professional familiar with your circumstances.
The Website is not an emergency service and is not monitored to provide immediate crisis assistance. If you or someone else is in immediate danger, call 911 or go to the nearest emergency department. In the United States, you can call or text 988, or visit 988lifeline.org, for the 988 Suicide & Crisis Lifeline. If you are outside the United States, contact your local emergency services or crisis support service.
4. Donations and purchases
Donations made through the Website may be processed by a third-party platform, including Zeffy. Your use of a third-party donation or payment platform is also subject to that provider’s terms, privacy practices, and policies. DANA does not control third-party platforms and is not responsible for their systems or practices.
The Website may link to an online shop offering items such as soaps, lotions, candles, gift sets, and books. Product descriptions, prices, availability, and images are provided for general information and may change. Purchases may be subject to additional checkout, shipping, return, or other terms presented during the transaction. If additional terms conflict with these Terms regarding a particular purchase, the purchase-specific terms will govern that transaction. See also our Shop Terms & Conditions.
A donation does not guarantee eligibility for or receipt of any DANA program or service. Whether a contribution is tax-deductible depends on applicable law and your individual circumstances. Consult a tax professional for advice about your donation.
5. Intellectual property and limited license
The Website and its content—including text, graphics, photographs, logos, designs, videos, and other materials—are owned by DANA or its licensors and are protected by intellectual-property laws. All rights not expressly granted in these Terms are reserved.
DANA grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Website and view or print Website content for your personal, noncommercial use. You may not reproduce, modify, distribute, publicly display, create derivative works from, or commercially exploit Website content without DANA’s prior written permission, except where applicable law permits.
Third-party names, marks, books, and other materials appearing on the Website may belong to their respective owners and may be subject to separate rights and terms.
6. Acceptable use
- Use the Website in violation of any applicable law or regulation.
- Interfere with or disrupt the Website, its servers, or its security features.
- Attempt to gain unauthorized access to any account, system, or information.
- Introduce malware, harmful code, or other material that could damage or impair the Website.
- Use automated tools to access, scrape, or copy Website content in a manner that burdens or disrupts the Website, unless permitted by law or authorized by DANA.
- Impersonate another person or misrepresent your affiliation with any person or organization.
- Submit unlawful, threatening, harassing, defamatory, fraudulent, infringing, or otherwise harmful material.
- Submit another person’s sensitive personal information, including information about a child, without appropriate authorization and a legitimate reason to do so.
- Use the Website to solicit or advertise without DANA’s written permission.
DANA may restrict or suspend access to the Website if it reasonably believes that a user has violated these Terms or poses a risk to the Website, DANA, or others.
7. User submissions and content
If you submit comments, feedback, inquiries, reviews, photographs, or other content through or in connection with the Website (“User Content”), you are responsible for that content and must have the rights and permissions needed to submit it.
You grant DANA a non-exclusive, worldwide, royalty-free license to use, reproduce, and display User Content as reasonably necessary to receive, respond to, moderate, or provide the feature for which you submitted it. If you choose to submit content for public display, this license also allows DANA to display that content in connection with that feature. DANA will not be required to publish or retain User Content and may remove it where appropriate.
Do not include confidential information or sensitive personal information in User Content unless DANA has specifically requested it through an appropriate process. Your submission does not, by itself, create a confidential or professional relationship with DANA.
8. Third-party links and services
The Website may link to third-party websites, payment platforms, resources, or services, including external news or crisis-support resources. These links are provided for convenience. DANA does not control or endorse third-party content, products, services, policies, or practices and is not responsible for them. Your use of third-party websites and services is at your own risk and subject to their terms and policies.
9. Disclaimer of warranties
To the fullest extent permitted by law, the Website and its content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. DANA disclaims warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, and non-infringement.
DANA does not warrant that the Website will be uninterrupted, secure, error-free, or free of harmful components, or that any defect will be corrected. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
10. Limitation of liability
To the fullest extent permitted by law, DANA and its directors, officers, employees, volunteers, agents, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, revenue, or profits, arising out of or related to your access to or use of, or inability to access or use, the Website or its content.
To the fullest extent permitted by law, the total liability of DANA and those persons for claims arising out of or relating to the Website or these Terms will not exceed the greater of US$100 or the amount you paid to DANA specifically for Website access during the 12 months before the event giving rise to the claim.
These limitations apply regardless of the legal theory and even if DANA has been advised of the possibility of damages. They do not limit liability that cannot be limited under applicable law.
11. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless DANA and its directors, officers, employees, volunteers, agents, and representatives from third-party claims, liabilities, damages, and reasonable costs arising from your violation of these Terms, your misuse of the Website, or your User Content. This obligation does not apply to the extent a claim results from DANA’s own conduct where applicable law does not permit such an obligation.
12. Governing law and venue
These Terms are governed by the laws of the State of Hawaii, United States, without regard to conflict-of-law principles. To the extent a claim may be brought in court, the state and federal courts located in Hawaii will have exclusive jurisdiction and venue, and you consent to that jurisdiction and venue. Nothing in this section prevents a consumer from asserting rights that cannot be waived under applicable law.
13. Changes to these Terms
DANA may revise these Terms from time to time. The updated Terms will be posted on the Website with a revised effective date. Changes apply upon posting unless a later effective date is stated. Your continued use of the Website after revised Terms are posted constitutes acceptance of those Terms. If you do not agree to revised Terms, stop using the Website.
14. Severability and entire agreement
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be limited or severed only to the extent necessary, and the remaining provisions will remain in effect.
These Terms constitute the agreement between you and DANA concerning your use of the Website and supersede any prior agreement on that subject. Additional terms may apply to particular programs, purchases, donations, or third-party services.
